At NJS Delivery, we provide reliable ocean freight shipping services for international shipments. Due to the nature of ocean freight logistics, certain factors beyond our control may impact delivery times. This policy outlines the key terms and conditions regarding shipping, timeframes, and liability related to ocean freight.

1. Shipping Locations and Coverage

  • NJS Delivery offers ocean freight shipping services from the U.S. to the Philippines. Shipping to other countries via ocean freight is available only upon request and subject to approval.

2. Estimated Shipping Timeframes

  • Ocean Freight Transit Time: The standard estimated transit time for ocean freight shipping is between 60 to 90 days. However, transit times may vary depending on the specific port, vessel schedule, and other logistical factors.
  • No Guarantee of Timely Delivery: While we make every effort to meet the estimated shipping timeframes, NJS Delivery makes no guarantees regarding exact delivery dates. The transit time is dependent on third-party carriers, customs processing, weather, and other uncontrollable factors.
  • Port Delays and Customs: Port congestion, customs clearance, or other unforeseen circumstances may result in delays. These factors are beyond NJS Delivery’s control and will not affect your responsibility for payment or incur any penalties against NJS Delivery.

3. Shipping Process and Deadlines

  • Order Processing: Orders will be processed within 1-3 business days from the date of payment confirmation. Ocean freight shipments typically require additional preparation time, including customs documentation and port coordination, which can extend processing time.
  • Booking and Confirmation: Once your order has been processed, NJS Delivery will confirm your ocean freight booking. This confirmation will include the estimated departure and arrival dates based on the vessel schedule.

4. Handling Delays and Force Majeure

  • Force Majeure Events: NJS Delivery will not be held liable for any delays or failure to meet estimated delivery times caused by force majeure events such as but not limited to natural disasters, extreme weather conditions, strikes, port disruptions, war, or other events outside our reasonable control.
  • Notification of Delays: We will notify you as soon as possible if there are any significant delays or changes in your shipping schedule. However, we are not responsible for delays that are beyond our control.

5. Tracking and Updates

  • Tracking Information: Once your ocean freight shipment departs, you will be provided with tracking information to monitor the progress of your goods. This tracking system may be updated with limited frequency based on the shipping line and customs processing.
  • Real-Time Updates: Although we strive to provide accurate tracking and real-time updates, please note that in some instances, delays in updating tracking information may occur during ocean freight transit, especially if the shipment is at sea or awaiting customs clearance.

6. Shipping Costs and Adjustments

  • Shipping Fees: Ocean freight shipping charges are based on the weight, volume, and nature of your goods, as well as the port of destination. Charges will be calculated at checkout, and NJS Delivery reserves the right to adjust shipping fees in the event of changes to fuel surcharges, port fees, or other unforeseen circumstances.
  • Additional Charges for Delays: If additional shipping fees are incurred due to delays caused by customs, government regulations, or other external factors, you will be notified promptly, and such fees will be the responsibility of the customer.

7. Damaged or Lost Shipments

  • Cargo Insurance: While we take great care in ensuring your items are shipped safely, ocean freight is inherently subject to risks such as damage during transport or potential loss at sea. We strongly recommend purchasing cargo insurance for full protection in case of loss or damage during shipping.
  • Claims for Damaged Goods: In the event your shipment is damaged during ocean freight transport, you must notify NJS Delivery within 7 days of receipt to file a claim. You will need to provide photographic evidence and a detailed description of the damage.
  • Lost Shipments: If your ocean freight shipment is lost, we will assist you in filing a claim with the carrier. However, NJS Delivery is not liable for the loss of goods during ocean transit unless cargo insurance has been purchased.

8. Customs and Import Duties

  • Customs Clearance: All shipments are subject to customs clearance in the destination country. Any customs or import duties, taxes, or fees are the responsibility of the recipient and are payable upon delivery.
  • Customs Delays: Customs processing can cause delays beyond the control of NJS Delivery. We will make every effort to assist with any required documentation or steps needed to facilitate customs clearance but are not liable for delays resulting from customs procedures.

9. Customer Responsibilities

  • Accurate Shipping Information: You are responsible for providing accurate shipping details, including the recipient’s address, contact information, and any customs-related documentation. Delays caused by incorrect or incomplete information will not be NJS Delivery's responsibility.
  • Compliance with Local Laws: You must ensure that the items being shipped comply with the laws and regulations of both the U.S. and the Philippines. NJS Delivery will not be liable for any goods that are prohibited or restricted by customs authorities.

10. Limitation of Liability

  • Indemnification of Liability: NJS Delivery will not be held liable for any loss, damage, delay, or non-delivery caused by third-party carriers, customs authorities, or any events beyond our control. The maximum liability of NJS Delivery is limited to the shipping fees paid for the affected shipment.
  • Acknowledgement of Risks: By using our ocean freight shipping services, you acknowledge and accept the risks associated with ocean freight, including potential delays, lost shipments, and damage. You agree to indemnify and hold NJS Delivery harmless for any such issues unless covered under our cargo insurance policy.
